Terms of Service

These Terms of Service explain how Airdelay provides flight compensation claim assistance, how our no-win, no-fee pricing works, and what you agree to when you submit a claim, sign a claim document, or use our claim-related services.

1. Introduction

These Terms of Service apply when you access or use Airdelay, submit a flight compensation claim, create an account, upload documents, sign a claim document, request claim assistance, or use any claim-related service provided through airdelay.net.

By using Airdelay, submitting a claim, ticking an acceptance box, creating an account, uploading documents, or providing an electronic signature where requested, you confirm that you have read and understood these Terms and our Privacy Policy. Where acceptance is required to create a claim or authorize claim handling, the version accepted by you is recorded and made available through the claim process or another durable medium.

If you submit a claim for another passenger or include additional passengers in your claim, you confirm that you have authority to provide their information, documents, and claim instructions to Airdelay.

2. Definitions

In these Terms, the following words have the meanings below:

  • “Airdelay,” “we,” “us,” and “our” mean Airdelay Danışmanlık Limited Şirketi, the company operating the Airdelay service through airdelay.net.
  • “You,” “customer,” “client,” or “passenger” means the person using Airdelay, submitting a claim, signing a claim document, or authorizing Airdelay to assist with a claim.
  • “Airline” means the operating air carrier, its representatives, payment handlers, or other claim-related party responsible for responding to or paying the claim.
  • “Claim” means a request handled by Airdelay for monetary compensation or another monetary amount connected with an eligible flight disruption.
  • “Flight disruption” means a delayed flight, cancelled flight, denied boarding, overbooking, missed connection, or another air-passenger-rights matter that Airdelay expressly agrees to review or handle.
  • “Compensation” means a monetary amount paid to Airdelay or to you, or a monetary settlement accepted by you, in connection with a claim handled by Airdelay. A voucher, points, miles, discount, upgrade, or other non-monetary benefit is not treated as Compensation unless you and Airdelay expressly agree otherwise in writing.
  • “Form” means any Assignment Agreement, Claim Authorization, Limited Power of Attorney, Authority to Act, Letter of Authority, certificate, declaration, electronic acceptance, or similar document used to allow Airdelay to provide the service.
  • “Service fee” means Airdelay’s 25% success fee, including VAT, charged only if Compensation is obtained.
  • “Transfer-related charges” means bank fees, payment provider fees, intermediary bank fees, recipient bank fees, repeated transfer fees, currency conversion charges, or similar charges connected with transferring money to you.

3. Who we are

Airdelay is the service name used by Airdelay Danışmanlık Limited Şirketi, a limited company registered in Türkiye. The company’s MERSİS number is 0010239499600001, and its registered office is Meşrutiyet Mah. Karanfil Sok. Zafir İş Merkezi No: 4, İç Kapı No: 91, Çankaya/Ankara, Türkiye.

Airdelay provides independent flight compensation claim assistance for passengers affected by flight delays, cancellations, denied boarding, overbooking, missed connections, and other flight disruptions that Airdelay agrees to handle. Customer communications are available through [email protected], +1 857 305 6367, and the Contact page.

Airdelay is not an airline, airport, government body, regulator, or law firm. Unless separately agreed in writing, Airdelay does not provide court representation, litigation services, legal advice, or legal representation before courts, regulators, enforcement bodies, or official authorities.

Airdelay may use trusted service providers, technical providers, payment providers, translation support, claim research tools, communication tools, or other claim-related support providers where reasonably needed to provide the service.

4. Our services

Airdelay’s service is focused on airline claim handling. This may include eligibility checks, claim preparation, document collection, claim authorization preparation, airline submission, airline communication, airline response review, payment request handling, claim status updates, and payment processing.

If compensation is obtained, we may receive it, deduct applicable amounts, and transfer the remaining balance to you.

Airdelay may decide whether a submitted claim is suitable for review, submission, continuation, closure, or further handling. We may refuse, pause, or close a claim for a reasonable claim-handling or compliance reason, including where it appears ineligible, unsupported, duplicate, time-barred, misleading, fraudulent, outside our service scope, commercially impractical to pursue through our current service, or impossible to process with the information available. Where appropriate, we will record or communicate the reason for closure.

5. Claim documents and forms

Before Airdelay starts or continues claim handling, you may be asked to accept these Terms, provide your electronic signature, and sign or approve a Form. The Form may be described as an Assignment Agreement, Claim Authorization, Limited Power of Attorney, Letter of Authority, Authority to Act, or a similar document.

Airdelay may select the claim-authorization Form reasonably suited to the airline, route, jurisdiction, claim type, document requirements, and practical claim-handling needs. The Form presented to you forms part of the claim arrangement and should be reviewed before signature.

The Form may authorize Airdelay to prepare and submit the claim, communicate with the airline, request claim-related information, provide supporting documents, receive airline responses, request compensation, receive compensation, deduct applicable fees and charges, and transfer the remaining balance to you.

Current scope

Unless a separate written agreement says otherwise, Airdelay’s authority is limited to airline claim handling and related payment processing. These Terms do not appoint Airdelay as your lawyer and do not authorize Airdelay to start court proceedings on your behalf.

6. Fees, no-win-no-fee pricing, and payments

Airdelay works on a no-win, no-fee basis. You do not pay an upfront Airdelay service fee for submitting a claim. Airdelay charges its service fee only if compensation is successfully obtained in connection with your claim.

25% Airdelay success fee If Compensation is obtained, Airdelay’s service fee is 25% of the Compensation amount, including VAT.
0 No fee if unsuccessful If no compensation is obtained, Airdelay does not charge its 25% service fee for that claim.

Transfer-related charges are separate from Airdelay’s 25% service fee. Only transfer-related charges that actually arise in connection with paying your share may be deducted. These may include bank, payment-provider, intermediary-bank, recipient-bank, currency-conversion, returned-transfer, or repeated-transfer charges. Airdelay does not add a separate markup to those third-party charges.

If Airdelay receives Compensation, Airdelay may deduct the 25% service fee, including VAT, and applicable actual transfer-related charges before sending the remaining balance to the payment details you provide. The claim record or payment communication will show the Compensation received, the Service fee, any transfer-related deduction known to Airdelay, and the amount sent to you.

If Compensation is paid directly to you in connection with a claim after you have authorized Airdelay and Airdelay has begun handling that claim, the 25% Service fee, including VAT, remains payable to the extent permitted by applicable law. Airdelay may ask for reasonable evidence of the amount and date of payment.

7. Eligibility and user confirmations

By using Airdelay or submitting a claim, you confirm that:

  • You have the legal capacity to enter into these Terms and submit the claim.
  • You are the passenger, or you are properly authorized to act for the passenger or passengers included in the claim.
  • All information, documents, signatures, passenger details, flight details, booking details, and payment details you provide are accurate, complete, current, and truthful.
  • You have not already assigned, transferred, settled, withdrawn, finally resolved, or received compensation for the same claim, unless you clearly tell Airdelay before submission.
  • No legal dispute, airline complaint, third-party claim process, or representative engagement is pending for the same claim unless disclosed to Airdelay before submission.
  • You will not appoint another claim company, representative, or third party to handle the same claim while Airdelay is actively handling it, unless the claim is first withdrawn or closed.
  • You will cooperate reasonably with Airdelay and provide additional documents or information when reasonably needed for claim handling.

8. Authorization, assignment, and authority to act

By submitting a claim, accepting these Terms, and signing or approving the required Form, you authorize Airdelay to handle the claim and, where the relevant Form provides for it, assign or transfer to Airdelay the claim rights needed to request, collect, and receive compensation connected with the flight disruption.

This authorization or assignment may include the right for Airdelay to contact the airline, submit the claim, request Compensation, communicate about claim resolution, receive Compensation where authorized, request supporting information, and take ordinary non-court claim-handling steps reasonably connected with the claim. Airdelay will not accept a settlement that materially reduces the principal monetary claim without your consent, unless the signed Form expressly and lawfully provides otherwise.

If an assignment is not valid, not suitable, or not required for a particular claim, the relationship between you and Airdelay may instead be treated as a service authorization, Claim Authorization, Limited Power of Attorney, Letter of Authority, or similar authority document allowing Airdelay to provide the service described in these Terms.

Once you authorize Airdelay or assign the claim through a Form, you must not assign the same claim to anyone else, submit the same claim through another claim company, pursue the same claim separately, accept direct airline payment without notifying Airdelay, or take steps that interfere with Airdelay’s claim handling.

Important limitation

Airdelay does not claim to act as a law firm, court representative, official enforcement body, or licensed legal representative. Any future court, regulator, lawyer, or legal-action process would require a separate written arrangement where applicable.

9. Authority to request and receive compensation

By submitting a claim and signing or approving the required Form, you authorize Airdelay to request that compensation connected with your claim be paid to an account controlled by Airdelay or to another payment method designated by Airdelay for claim handling.

If Compensation is received by Airdelay, Airdelay may deduct its 25% Service fee, including VAT, and applicable actual transfer-related charges before transferring the remaining balance to you.

Airdelay will process the customer payment within a reasonable period after the funds are cleared, the claim payment is matched, required compliance checks are completed, and valid payment details are available. Processing times may vary because of banking procedures, currency conversion, weekends, holidays, compliance checks, and information provided by you. Nothing in these Terms removes any mandatory right you may have under applicable law.

If you do not provide correct payment details after reasonable reminders, or remain unresponsive after Compensation is ready for transfer, Airdelay may hold the customer share safely until valid payment information is provided and may take any further step required by applicable unclaimed-property, accounting, or limitation rules.

10. Your responsibilities during the claim

You agree to cooperate reasonably with Airdelay and to provide requested information or documents where needed for claim handling.

  • You must provide accurate flight, booking, passenger, document, and payment information.
  • You must tell Airdelay promptly if the airline contacts you, makes an offer, asks for documents, rejects the claim, or pays you directly.
  • You must forward or disclose claim-related airline correspondence to Airdelay where relevant.
  • You must not provide false, misleading, incomplete, altered, or fraudulent information or documents.
  • You must keep your contact and payment details up to date.
  • You must provide additional authorization, identity, booking, travel, or claim documents if reasonably required by the airline or claim process.
  • You must not take actions that duplicate, interrupt, weaken, settle, withdraw, or conflict with the claim while Airdelay is actively handling it.

If incorrect, incomplete, misleading, or fraudulent information causes extra costs, payment delays, claim failure, duplicate claim issues, airline rejection, or other losses, Airdelay may close the claim and may seek reimbursement where permitted by law.

11. Direct payment, vouchers, and airline offers

If the airline, its representative, or another claim-related party pays compensation directly to you after you have authorized Airdelay or after Airdelay has started handling the claim, you must inform Airdelay promptly and provide reasonable proof of the amount received.

Direct payment to you will still be treated as compensation obtained in connection with the claim. Airdelay’s 25% Service fee, including VAT, remains payable if the compensation was obtained after Airdelay was authorized or after Airdelay took steps to prepare, submit, communicate about, manage, or support the claim.

If the airline offers a travel voucher, points, miles, discount, upgrade, service credit, or another non-monetary benefit in response to the claim, you must tell Airdelay promptly before accepting it because acceptance may affect or settle the monetary claim.

A non-monetary benefit is not subject to the 25% Service fee unless you and Airdelay expressly agree otherwise in writing. If accepting the benefit prevents further handling of the monetary claim, Airdelay may close the claim.

12. Fellow passengers, shared bookings, and minors

If you include other passengers in a claim, you confirm that you have permission to provide their information and documents. Each adult passenger may be required to review and sign their own authorization. You must not sign on behalf of another adult unless you have legally sufficient authority to do so.

If you include a child or minor passenger, you confirm that you are the parent, legal guardian, or person legally authorized to act for that child, or that you have obtained proper permission from the parent or legal guardian.

Airdelay may request additional proof of authority for fellow passengers, children, or minors, including written consent, guardian information, signatures, identity documents, or other supporting documents.

In shared-booking or family claims, Airdelay may transfer compensation to one payment account if the relevant passengers authorize this or if one account is provided for the claim. The person receiving compensation for others is responsible for distributing the correct amounts to them.

13. Documents, signatures, and electronic acceptance

You authorize Airdelay to rely on the electronic signature, checkbox acceptance, uploaded documents, claim information, account information, and payment information you provide when preparing, submitting, and managing the claim.

Airdelay may generate, store, and use claim documents based on your submitted information, including a Claim Authorization, Limited Power of Attorney, Assignment Agreement, Authority to Act, payment request, airline claim letter, claim summary, or other claim-related document.

You understand that airlines may request identity documents, passport or ID copies, travel documents, booking confirmations, boarding passes, tickets, signatures, proof of authority, or other supporting documents before processing a claim. You authorize Airdelay to submit these documents to the airline or relevant claim-handling party where reasonably required for claim handling.

Airdelay may keep records of your acceptance, signature, submission time, technical submission data, claim submission, document and authorization versions, uploaded files, payment details, and claim-related communications for evidence, security, compliance, payment, dispute resolution, fraud prevention, and service purposes, as described in our Privacy Policy.

14. Withdrawal, cancellation, or closure of a claim

You may request withdrawal or closure through the Contact page or another method clearly made available by Airdelay. Closing an account does not by itself withdraw an active claim authorization.

Where mandatory consumer law gives you a 14-day right of withdrawal, the period generally starts when the distance service contract is concluded. Airdelay will provide the applicable pre-contract information and a withdrawal method on a durable medium where required.

Airdelay will begin claim handling during the withdrawal period only where you have made the legally required express request. If you withdraw after requesting early performance, you may be responsible only for a proportionate amount for services supplied up to withdrawal where applicable law permits it and where you were properly informed in advance.

The withdrawal right may end after the service has been fully performed only where the conditions required by applicable law are satisfied, including any required prior consent and acknowledgment. These Terms alone do not remove a mandatory withdrawal right.

If Compensation was already obtained before a valid withdrawal or closure took effect, the 25% Service fee, including VAT, remains payable as permitted by applicable law. A mere eligibility estimate, airline acknowledgment, rejection, or unaccepted offer does not by itself mean Compensation was obtained.

Airdelay may refuse, pause, or close a claim for a reasonable claim-handling, legal, security, or compliance reason, including where the claim appears ineligible, unsupported, duplicate, fraudulent, abusive, impossible to process, affected by missing or incorrect information, outside our service scope, or prevented by airline, payment, legal, operational, compliance, or force-majeure circumstances.

15. No guarantee of compensation

Airdelay does not guarantee that compensation will be obtained. Claim outcomes can depend on the route, airline, disruption reason, delay length, cancellation notice, documents, passenger-rights rules, airline responsibility, airline response, limitation periods, payment procedures, and other facts outside Airdelay’s control.

Any eligibility estimate, compensation estimate, claim status, or claim assessment shown by Airdelay is not a guarantee of payment or legal outcome.

Airdelay may decide not to continue with a claim if, after review, it appears unlikely to succeed, is outside the scope of our service, lacks required documentation, is affected by extraordinary circumstances, has already been resolved, or cannot reasonably be pursued through airline claim handling.

16. Payment details and incorrect information

You are responsible for providing accurate and complete payment details. Airdelay is not responsible for delays, failed transfers, returned transfers, deductions, losses, or payments made to an incorrect recipient where this is caused by inaccurate, incomplete, outdated, or misleading payment information provided by you.

If a transfer is returned or cannot be completed, Airdelay may request updated payment details. Additional transfer-related charges may be deducted from your share where they arise from returned, failed, repeated, intermediary, or corrected payment attempts.

Airdelay may refuse to transfer compensation to a third-party account, intermediary, agency, representative, or person who is not the passenger or authorized recipient unless Airdelay receives clear proof of authority and is satisfied that the payment can be made safely and lawfully.

17. Privacy, service emails, and data use

Airdelay Danışmanlık Limited Şirketi processes personal data, claim information, travel documents, identity documents, signatures, passenger details, and payment information as described in our Privacy Policy.

By submitting a claim, you understand that your information may be used for claim handling, eligibility review, airline submission, document preparation, payment processing, service communication, security, compliance, fraud prevention, record keeping, and related purposes.

Claim-related emails, account messages, document requests, payment requests, and status updates are service communications and are not marketing emails. Marketing emails are optional and may be sent only where you have consented or where otherwise permitted by applicable law. You may unsubscribe from marketing emails at any time.

Airdelay may share claim-related information with airlines, claim-related parties, payment providers, identity or document-verification support, technical providers, translation providers, professional advisers, or other trusted service providers only where reasonably needed to provide the service, protect the claim, process payment, prevent fraud, or comply with applicable requirements.

18. Limitation of liability

Airdelay is not responsible for an adverse result or delay to the extent it is caused by an airline decision, airline delay or refusal, inaccurate airline information, missing or incorrect information provided by you, a duplicate or time-barred claim, a bank or payment-provider delay, currency-conversion movement, or another event outside Airdelay’s reasonable control. This does not excuse Airdelay from exercising reasonable care in performing its own obligations.

Airdelay is not liable for indirect, incidental, special, consequential, or business losses, including loss of profit, loss of opportunity, loss of data, or loss caused by third-party systems, except where such limitation is not permitted by applicable law.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including any mandatory consumer rights that apply to you.

19. Changes, governing law, language, and disputes

Airdelay may update these Terms for future use. The version recorded as accepted for your claim will generally continue to govern that claim unless you accept a later version or a change is required by mandatory law. Material changes will not be applied retroactively to reduce an accrued mandatory consumer right.

If any provision is invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.

These Terms are governed by the laws of the Republic of Türkiye. This choice does not deprive a consumer of mandatory protections that apply under the law of the consumer’s country of habitual residence. Consumers may use the consumer arbitration committee, consumer court, court, regulator, or alternative dispute-resolution channel that has mandatory jurisdiction over the dispute.

Please raise a complaint with Airdelay first through the Contact page so that we have an opportunity to resolve it directly. This does not restrict your right to apply to a competent authority or court.

These Terms may be provided in English, Turkish, and German. Each language version is intended to communicate the same contractual terms. No translation is intended to reduce mandatory consumer rights. Where wording differs, it will be interpreted consistently with the version accepted for the claim, the transaction records, and applicable mandatory law.
